Jurisprudential discourse of shaving in Islam

Abstract

Investigating the issue of "shaving beard" with the aim of knowing its Sharia ruling is essential; In this descriptive-analytical research, Baroosh asked the question: "What is the Shari'i rule of shaving?" The answer has been given. The Shariah ruling of "shaving the beard" is always discussed and disputed from the point of view of religious experts and researchers, and there are three jurisprudential approaches in this matter. Most of the Shia and Sunni jurists have declared the sanctity of shaving a beard, citing the reasons of narration. On the other hand, other people have denied their reasons and considered the common custom of shaving a beard to be subject to the changeable tradition of the Innocents (AS). The authority's fatwa regarding the production, buying and selling of shaving tools and interacting with barbers is the criterion of sanctity or license of shaving, and it is difficult to issue a general ruling of license or sanctity in this case. Because some jurists have prohibited the production of shaving tools, buying and selling them, considered the wages of shaving beards haram and classified the shaver as a sinner, while others believe that it is permissible to shave it.

بررسی موضوع «تراش‌ریش» با هدف شناخت حکم شرعی آن ضرورت اساسی دارد؛ در این تحقیق باروش توصیفی-تحلیلی به‌پرسش: «حکم شرعی ریش‌تراشی چیست؟» پاسخ گفته شده است. حکم شرعی «تراش‌ریش» از دیدگاه کارشناسان و محققان دینی همواره مورد بحث و مناقشه واقع شده و سه رویکرد فقهی در این مورد وجود دارد. اکثر فقیهان تشیع و تسنن با استناد به‌دلایل نقلی، حکم حرمت ریش‌تراشی را اظهار نموده اند. در مقابل، افراد دیگری، دلایل آنان‌را انکار نموده و عرف رایج ریش‌تراشی را تابع سنت تغییر پذیر معصومین (ع) دانسته اند. فتوای مرجع تقلید ریش‌تراش نسبت به‌تولید، خرید و فروش ابزار ریش‌تراشی و تعامل با ریش‌تراشان ملاک حرمت یا جواز ریش‌تراشی می‌باشد و صدور حکم کلی جواز یا حرمت دراین مورد دشوار است. زیرا برخی از فقیهان، تولید ابزار ریش‌تراشی، خرید و فروش آن‌را ممنوع دانسته، اجرت تراش‌ریش را حرام شمرده و ریش‌تراش را جزء فاسقان قرار داده است، درحالیکه برخی دیگر، قائل به‌جواز تراش آن است.
